    AZ Solar Terms & Conditions

    1. Parties to this agreement

    These Terms and Conditions form an agreement between JALA ELECTRICALS PTY LTD ABN 71 640 116 338 trading as AZ Solar of 17 Paragon St, Rochedale QLD 4123 and the customer named in the quotation, proposal, invoice or agreement.

    In these Terms and Conditions:

    • “AZ Solar”, “we”, “us” or “our” means JALA ELECTRICALS PTY LTD trading as AZ Solar.
    • “Customer”, “you” or “your” means the person, company or entity purchasing the system or services from us.
    • “System” means the solar PV system, battery system, inverter, panels, mounting equipment, monitoring equipment, electrical works and related goods or services listed in the quotation.
    • “Site” or “Premises” means the installation address listed in the quotation.
    • “Installer” means AZ Solar, our employees, contractors, subcontractors, licensed electricians, accredited designers or accredited installers engaged to perform the works.

    These Terms apply together with the quotation, invoice, system design, warranty documents, product datasheets and any written variations agreed between you and AZ Solar.

    2. Acceptance of quotation

    You accept our quotation and enter into this agreement when you do any of the following:

    • sign and return the quotation or agreement;
    • accept the quotation by email, SMS, online form or customer portal;
    • pay a deposit or any part of the quoted price; or
    • instruct us to proceed with arranging, supplying or installing the System.

    If the contract price is above $5,000, we may require a signed written acceptance before proceeding.

    By accepting the quotation, you confirm that you have read, understood and accepted these Terms and Conditions.

    3. Customer warranties and responsibilities

    You warrant and confirm that:

    • you are at least 18 years old;
    • you are the registered owner of the Premises, or you have authority from all registered owners to enter into this agreement;
    • you have authority to allow the installation works to be performed at the Premises;
    • you have obtained, or will obtain, any required approvals from the local council, body corporate, strata manager, landlord, property manager, electricity retailer, electricity distributor or other relevant authority;
    • all information you provide to us is accurate and complete;
    • you have told us about any roof defects, asbestos, electrical issues, access issues, shading, obstructions, safety hazards or site conditions that may affect the installation; and
    • the Premises is safe and suitable for our installers to access and perform the work.

    If any information you provide is incorrect, incomplete or misleading, you may be responsible for additional costs, delays, redesigns, cancellations or losses caused by that information.

    4. System design and quotation

    Our quotation is based on the information available to us at the time, including information provided by you, satellite imagery, photos, electricity bills, site information and product availability.

    The final System design may change if we identify issues including, but not limited to:

    • roof obstructions;
    • shading;
    • unsafe roof access;
    • poor roof condition;
    • meter box or switchboard issues;
    • electricity distributor requirements;
    • product availability;
    • changes to laws, standards, rebates or compliance requirements;
    • structural limitations;
    • battery location restrictions; or
    • any condition not reasonably visible or known before installation.

    If a change is required, we will discuss the issue with you before proceeding where practical. Any additional cost will be treated as a variation.

    5. Payment

    Unless otherwise stated in writing:

    • the deposit must be paid when you accept the quotation;
    • the balance must be paid before installation;
    • AZ Solar may pause installation, grid paperwork, commissioning, warranty assistance or handover documents until all overdue amounts are paid;
    • payment may be made by bank transfer, card payment, finance provider, cheque or any other method approved by AZ Solar; and
    • card payments, finance payments or third-party payment methods may attract additional fees if disclosed to you before payment.

    You must not withhold payment because of a minor issue that does not prevent the System from being safely installed or commissioned. If there is a genuine defect or dispute, you must notify us in writing and give us a reasonable opportunity to inspect and resolve the issue.

    Cyber Alert: There is a risk of cyber fraud, including fake invoices, fake emails, fake SMS messages or people pretending to represent AZ Solar. AZ Solar will not be responsible for payments made to an incorrect bank account unless the error was caused by AZ Solar’s proven negligence. Before making payment, you should verify our bank details by calling AZ Solar using the phone number listed on our official website or quotation. Do not rely only on bank details sent by SMS, social media, WhatsApp or an unfamiliar email address.

    6. Compliance paperwork

    AZ Solar may submit compliance paperwork, electrical certificates, grid connection documents, STC documents, warranty forms and handover documents after the relevant works are completed and the balance has been paid in full.

    We may withhold or delay submission of paperwork if:

    • payment is outstanding;
    • required customer information has not been provided;
    • required signatures have not been provided;
    • distributor approval is pending;
    • commissioning has not been completed; or
    • a safety or compliance issue must first be resolved.

    7. Exclusions from the quoted price

    Unless expressly included in the quotation, the quoted price does not include:

    • meter box upgrades;
    • switchboard upgrades;
    • consumer mains upgrades;
    • asbestos removal;
    • roof repairs;
    • structural engineering reports;
    • council, strata or body corporate approvals;
    • electricity distributor application fees;
    • export control devices;
    • smart meter changes or retailer meter fees;
    • trenching, concrete cutting or underground cabling;
    • cherry picker, scissor lift, scaffolding or special access equipment;
    • bird proofing;
    • removal and disposal of old panels or equipment;
    • additional AC, DC or data cabling beyond the allowance in the quotation;
    • battery bollards, cages, enclosures or fire-rated backing boards unless included;
    • antenna relocation;
    • internet, Wi-Fi extenders, SIM cards or data cabling;
    • backup circuits for batteries unless included;
    • generator integration;
    • off-grid works unless included; or
    • any work not specifically listed in the quotation.

    8. Grid connection approval

    You authorise AZ Solar to apply for grid connection approval on your behalf where required.

    You acknowledge that the electricity distributor, retailer or relevant authority may:

    • approve the application;
    • reject the application;
    • delay the application;
    • require additional information;
    • impose a partial export limit;
    • impose a zero export limit;
    • require an export control device;
    • require a meter or switchboard upgrade; or
    • impose other conditions.

    AZ Solar is not responsible for distributor or retailer decisions, delays, export limits, meter delays or grid restrictions.

    If the distributor imposes extra requirements, you are responsible for the additional cost unless we have expressly included that cost in the quotation.

    9. Loss of feed-in tariff

    If you already have a solar system, upgrading, replacing or adding to that system may affect your current feed-in tariff, metering arrangement, rebate eligibility or electricity retailer plan.

    You are responsible for checking with your electricity retailer before proceeding.

    AZ Solar does not guarantee that your current feed-in tariff will remain unchanged. AZ Solar is not liable for any loss of feed-in tariff, change in tariff rate, loss of rebate, reduced savings or change to your electricity plan caused by the installation, upgrade or replacement of a system.

    10. Delivery and installation dates

    Any installation date, delivery date or completion date given by AZ Solar is an estimated target date only, unless expressly stated in writing as a guaranteed date.

    Installation may be delayed by factors including:

    • weather;
    • unsafe site conditions;
    • product availability;
    • supplier delays;
    • distributor approval delays;
    • customer unavailability;
    • access issues;
    • roof or electrical defects;
    • installer illness or emergency;
    • force majeure events; or
    • any matter outside our reasonable control.

    AZ Solar will make reasonable efforts to complete the installation within a reasonable time but is not liable for loss, inconvenience, wages, travel costs or other expenses caused by reasonable delays.

    11. Site access

    You must provide safe and reasonable access to the Premises for site inspections, delivery, installation, commissioning, maintenance and warranty work.

    You or an authorised adult representative must be present if requested by AZ Solar.

    If we attend the Premises and cannot perform the work because access is not available, the site is unsafe, required approvals are missing, or you are not present when required, we may charge a call-out fee or rescheduling fee.

    You must ensure that:

    • pets are secured;
    • vehicles and obstacles are moved;
    • the switchboard and inverter location are accessible;
    • roof access is reasonably safe;
    • fragile items are moved away from work areas; and
    • installers can safely perform the required works.

    12. Installation location and customer preferences

    You may tell us your preferred location for panels, inverter, battery and other equipment.

    We will consider your preference, but the final location must comply with:

    • Australian Standards;
    • Solar Accreditation Australia requirements;
    • manufacturer requirements;
    • electrical safety requirements;
    • distributor requirements;
    • battery safety requirements; and
    • practical site conditions.

    AZ Solar and the accredited installer may refuse to install equipment in a location that is unsafe, non-compliant, impractical or likely to reduce performance.

    If you are not present during installation, you authorise AZ Solar and the installer to make reasonable decisions about equipment placement, cable routes and installation methods.

    13. Cable management

    Unless otherwise stated in the quotation, standard cable allowances are:

    • up to 20 metres of DC cable for a single-storey property;
    • up to 40 metres of DC cable for a double-storey property; and
    • up to 5 metres of AC cable for all premises.

    Additional cabling, conduit, trenching, cable tray, data cabling, concrete cutting, roof space access or complex cable runs may incur additional charges.

    Cable routes will be selected by the installer based on safety, compliance, practicality and site conditions.

    14. Meter box and switchboard

    The quoted price does not include meter box upgrades, switchboard upgrades, consumer mains upgrades, defect rectification, asbestos removal or retailer meter changes unless expressly stated in the quotation.

    If your meter box, switchboard or wiring is not compliant or suitable for the System, you must pay for any required upgrades or rectification before the System can be connected or commissioned.

    AZ Solar is not liable for delays caused by meter providers, electricity retailers, distributors, switchboard defects or customer-side electrical issues.

    15. Building defects, roof condition and obstructions

    You warrant that the Premises is structurally sound, safe, free from asbestos and suitable for installation.

    You must notify AZ Solar before installation if you are aware of:

    • brittle roof tiles;
    • cracked tiles;
    • rusted tin;
    • roof leaks;
    • damaged roof framing;
    • asbestos;
    • unsafe access;
    • skylights;
    • antennas;
    • satellite dishes;
    • vents;
    • pipes;
    • air conditioning units;
    • hot water systems;
    • shade from trees or neighbouring buildings; or
    • any other obstruction or hazard.

    AZ Solar is not responsible for pre-existing defects, structural weaknesses, asbestos, unsafe roof conditions or damage caused by defects that were not caused by our negligence.

    16. Roof tiles, tin roofs and roof damage

    During installation, installers may need to walk on the roof while carrying solar panels, rails, tools and equipment.

    For tile roofs, some tiles may crack or break during normal installation work. You should keep spare matching tiles available on site before installation starts.

    If tiles break during installation and you have provided spare tiles, our installer will use reasonable efforts to replace them. If no spare tiles are provided, you are responsible for sourcing suitable replacement tiles.

    For tin or metal roofs, minor marks, dents or scratches may occur during normal installation work. AZ Solar will only be responsible for roof damage to the extent it is caused by our negligence or the negligence of our contractors.

    Nothing in this clause limits your rights under the Australian Consumer Law.

    17. Accredited installers and subcontractors

    AZ Solar uses both employees and subcontractors, including licensed electricians, Solar Accreditation Australia accredited installers and accredited designers, to perform the works in the areas we service across Queensland, New South Wales and Victoria.

    We will use appropriately licensed and accredited persons where required by law, standards or scheme rules.

    Solar Accreditation Australia is the body responsible for accreditation requirements for solar and battery designers and installers. The Clean Energy Council maintains approved product lists for solar PV modules, inverters and batteries that meet relevant standards.

    18. Approved products

    AZ Solar will install products that are suitable for the relevant system type and compliance requirements.

    Where STCs, rebates or accreditation rules require approved products, AZ Solar will use products listed on the relevant approved product list at the time required.

    If a quoted product becomes unavailable, discontinued or unsuitable, AZ Solar may offer an equivalent or better replacement product. If the replacement materially changes the System or price, we will seek your approval before proceeding.

    19. Australian Consumer Law

    Nothing in these Terms and Conditions excludes, restricts or modifies any right or guarantee you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

    Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. For minor failures, we may choose to repair the goods or fix the service within a reasonable time.

    The ACCC provides mandatory wording for warranties against defects, and businesses must not mislead customers about consumer guarantees.

    20. Manufacturer warranties

    Solar panels, inverters, batteries and other components are covered by the manufacturer’s warranty terms.

    Manufacturer warranties may include conditions relating to:

    • installation requirements;
    • internet connectivity;
    • monitoring;
    • maintenance;
    • environmental conditions;
    • product registration;
    • usage limits;
    • battery cycling;
    • firmware updates; and
    • approved repair processes.

    AZ Solar will provide reasonable assistance with manufacturer warranty claims, but the final warranty decision may be made by the manufacturer.

    Manufacturer warranty periods do not replace or limit your rights under the Australian Consumer Law.

    21. Workmanship warranty

    AZ Solar provides a 10-year workmanship warranty plus a 1-year limited property damage warranty from the date of installation, unless a different period is stated in writing.

    This workmanship warranty covers defects caused by installation workmanship.

    It does not cover:

    • damage caused by misuse, neglect or accidental damage;
    • damage caused by storms, hail, lightning, flood, fire, pests, animals or force majeure events;
    • damage caused by third-party works;
    • damage caused by unauthorised repairs or modifications;
    • pre-existing building, roof or electrical defects;
    • product defects covered by manufacturer warranty;
    • loss of Wi-Fi or internet connectivity;
    • reduced performance caused by shading, dirt, debris or lack of maintenance;
    • changes to laws, standards, distributor rules or retailer rules after installation; or
    • faults caused by failure to follow shutdown, operation or maintenance instructions.

    22. Safety warning

    Solar PV systems and battery systems can pose a risk of electric shock, fire or serious injury if handled incorrectly.

    You must not touch, move, open, modify, repair, disconnect or interfere with any part of the System unless following the shutdown procedure or acting under instruction from a licensed electrician or emergency authority.

    Only suitably licensed and accredited persons should inspect, repair, modify or remove the System.

    23. Reduced performance

    The performance of a solar or battery system may be affected by many factors, including:

    • weather;
    • shading;
    • panel orientation;
    • panel tilt;
    • roof pitch;
    • dirt, dust, leaves or bird droppings;
    • grid voltage;
    • export limits;
    • battery usage patterns;
    • household consumption;
    • equipment settings;
    • degradation over time; and
    • changes to electricity tariffs.

    Any savings, payback period, performance estimate or production estimate is an estimate only, not a guarantee.

    If you choose to proceed with a System despite shading, non-north orientation, flat roof installation, roof obstructions or other known limitations, AZ Solar is not liable for reduced generation, reduced savings or reduced feed-in tariff.

    24. STCs, rebates and incentives

    If your quotation includes a discount for Small-scale Technology Certificates, rebates or incentives, you agree to assign the right to create and claim those certificates, rebates or incentives to AZ Solar or our nominated agent, unless otherwise agreed in writing.

    The Clean Energy Regulator says most system owners assign the right to create STCs to a registered agent in exchange for an upfront discount.

    You must provide accurate information and sign all required documents for STCs, rebates or incentives.

    If STCs, rebates or incentives are rejected, reduced, delayed, unavailable or clawed back because of incorrect information, customer ineligibility, refusal to sign documents, changes in law or circumstances outside AZ Solar’s control, you must pay the difference between the quoted discounted price and the amount actually received by AZ Solar.

    25. Wi-Fi and monitoring

    Some inverters, batteries and monitoring systems require a stable internet connection.

    You are responsible for providing and maintaining:

    • active internet service;
    • suitable Wi-Fi signal at the inverter or battery location;
    • correct Wi-Fi password;
    • router access if required;
    • Wi-Fi extenders, SIM cards or data cabling if needed; and
    • ongoing internet connection after installation.

    AZ Solar will connect monitoring at the time of installation where practical. Future reconnection due to changed router, changed password, changed internet provider, weak signal or customer-side internet issue may incur a service fee.

    Loss of internet connection may affect monitoring, warranty support, battery operation, remote diagnostics or compliance requirements.

    26. Variations and additional costs

    AZ Solar may charge additional costs if extra work, equipment or materials are required, including for:

    • extra cabling;
    • difficult access;
    • double-storey or high-set buildings;
    • steep roofs;
    • fragile roofs;
    • switchboard upgrades;
    • meter box works;
    • export control devices;
    • distributor requirements;
    • trenching;
    • concrete cutting;
    • antenna relocation;
    • bird proofing;
    • panel removal;
    • battery bollards;
    • battery enclosures;
    • fire-rated backing boards;
    • backup circuits;
    • additional site visits;
    • generator integration;
    • off-grid requirements; or
    • any other work not included in the quotation.

    If you do not agree to a required variation, either party may cancel the agreement. If cancelled, AZ Solar will refund amounts paid by you, less reasonable costs already incurred, including design fees, distributor fees, site inspection fees, special-order product costs, finance fees or other non-recoverable costs, to the extent permitted by law.

    27. Cancellation and refunds

    You may cancel the agreement before installation by giving written notice to AZ Solar.

    If you cancel after accepting the quotation, AZ Solar may deduct reasonable costs already incurred, including:

    • site inspection costs;
    • administration costs;
    • design costs;
    • grid application fees;
    • distributor fees;
    • finance fees;
    • restocking fees;
    • special-order product costs;
    • delivery costs; and
    • work already performed.

    AZ Solar may cancel the agreement if:

    • the distributor refuses approval;
    • the site is unsafe or unsuitable;
    • required approvals are not obtained;
    • required products are unavailable;
    • installation would be non-compliant;
    • you do not pay amounts when due;
    • you provide incorrect or incomplete information;
    • required variations are not accepted; or
    • circumstances outside our control prevent installation.

    Any refund will be handled in accordance with Australian Consumer Law.

    28. Battery systems

    If the System includes a battery, you acknowledge that battery installation is subject to strict safety, location and compliance requirements.

    Battery location may be restricted by:

    • Australian Standards;
    • manufacturer instructions;
    • fire safety requirements;
    • ventilation requirements;
    • clearance zones;
    • vehicle impact risks;
    • habitable room restrictions;
    • weather exposure; and
    • installer assessment.

    The accredited installer has final authority to determine whether a proposed battery location is safe and compliant.

    Additional costs may apply for:

    • bollards;
    • fire-rated backing boards;
    • cages;
    • enclosures;
    • weather protection;
    • cable upgrades;
    • backup circuits;
    • switchboard works;
    • relocation; or
    • other safety requirements.

    29. Battery backup

    A battery system does not automatically provide backup power during a blackout unless backup capability is expressly included in the quotation.

    Backup circuits, backup gateways, changeover equipment or additional wiring may cost extra.

    Not all appliances can be connected to backup power. Appliances with high start-up loads or high power requirements may exceed the battery or inverter capacity.

    AZ Solar does not guarantee that battery backup will power your whole home unless this is expressly stated in writing.

    30. Battery maintenance and protection

    You must keep the battery area clean, ventilated, accessible and free from hazards.

    You must not store flammable materials near the battery.

    You must maintain required clearances around the battery at all times.

    Battery maintenance, repairs, relocation, expansion or modifications must only be performed by suitably licensed and accredited persons.

    Failure to follow manufacturer instructions may void manufacturer warranty and may create safety risks.

    31. Battery usage

    Battery performance and warranty may depend on usage, cycling, temperature, internet connection, firmware, maintenance and manufacturer requirements.

    If a battery is turned off, left unused or allowed to remain discharged for an extended period, it may fail or suffer damage that is not covered by warranty.

    If you plan to leave the battery unused for an extended period, you must follow the manufacturer’s storage and shutdown instructions.

    32. Unauthorised modifications

    You must not allow any unauthorised person to modify, repair, relocate, expand, remove or interfere with the System.

    Unauthorised modifications may void workmanship warranty, manufacturer warranty, rebate eligibility and compliance approvals.

    This includes attaching non-approved batteries, second-hand equipment, off-the-shelf batteries or equipment not approved by AZ Solar, the manufacturer or the relevant standards.

    33. Off-grid systems

    If the System is off-grid or hybrid/off-grid capable, additional site assessment, engineering, generator integration, load assessment and design work may be required.

    Unless expressly included in the quotation, you are responsible for supplying, maintaining and operating any generator.

    AZ Solar does not guarantee that an off-grid system will support all appliances, all loads or all usage patterns unless this is expressly stated in writing.

    34. Complaints and dispute resolution

    If you have a complaint, you must contact AZ Solar first and give us a reasonable opportunity to resolve the issue.
    We will review your complaint and respond within a reasonable time.
    Nothing in this clause limits your rights to contact a regulator, consumer protection body or tribunal.

    35. Privacy

    AZ Solar will collect, use and disclose your personal information as reasonably required to provide the quotation, arrange installation, apply for grid connection, process rebates or STCs, arrange finance, register warranties, communicate with you and comply with legal obligations.

    We may provide your information to installers, subcontractors, suppliers, manufacturers, distributors, electricity retailers, finance providers, rebate administrators, government bodies and warranty providers where reasonably required.

    36. Limitation of liability

    To the maximum extent permitted by law, AZ Solar is not liable for:

    • indirect, special or consequential loss;
    • loss of profit, revenue, business or goodwill;
    • loss of anticipated savings;
    • loss of feed-in tariff;
    • electricity retailer or distributor decisions;
    • export limits;
    • rebate or STC changes;
    • delays outside our reasonable control;
    • pre-existing building, roof or electrical defects;
    • customer-side internet issues;
    • third-party modifications;
    • weather events;
    • pest or animal damage;
    • loss caused by incorrect information provided by you; or
    • loss caused by your failure to follow instructions.

    Where liability cannot be excluded, AZ Solar’s liability is limited to the remedies permitted by law.

    Nothing in this clause excludes your rights under Australian Consumer Law.

    37. Indemnity

    You agree to indemnify AZ Solar against reasonable costs, losses, damages, claims and expenses arising from:

    • your breach of this agreement;
    • incorrect or incomplete information provided by you;
    • lack of site access;
    • unsafe site conditions not disclosed to us;
    • failure to obtain required approvals;
    • unauthorised modifications to the System;
    • failure to pay amounts due;
    • your misuse of the System; or
    • your failure to follow safety, operation or maintenance instructions.

    This indemnity does not apply to the extent the loss was caused by AZ Solar’s negligence, breach of contract or breach of law.

    38. Licences

    AZ Solar holds or uses appropriately licensed contractors for electrical and solar installation work. Installation work is performed by our employees and appropriately licensed subcontractors.

    Relevant licence and accreditation details are available upon request where required.

    39. Changes to quotation or terms

    Any change to the quotation, system design, product selection, price or these Terms must be agreed in writing, including by email, SMS, signed variation or updated invoice.

    Handwritten changes or customer edits to the quotation are not valid unless accepted by AZ Solar in writing.

    40. Force majeure

    AZ Solar is not liable for delay or failure to perform caused by events outside our reasonable control, including severe weather, natural disasters, fire, flood, pandemic, supplier delays, product shortages, industrial action, grid delays, government action, changes in law, accidents or safety incidents.

    41. Governing law

    This agreement is governed by the laws of Queensland, Australia, unless the quotation states otherwise.

    The parties submit to the non-exclusive jurisdiction of the courts and tribunals of Queensland.

    42. Entire agreement

    The quotation, these Terms and Conditions, any written variations, product warranty documents and system design documents form the entire agreement between you and AZ Solar.

    If there is inconsistency between these documents, the quotation and any written variation will apply first, followed by these Terms and Conditions, unless required otherwise by law.
